Swastik Builder is engaged in construction, real estate development, property consultation, and customer communication services, including official messaging through WhatsApp Business API and RCS Business Messaging.
These Terms establish a legally binding agreement between Swastik Builder (“Company”, “we”, “us”, “our”) and the user (“you”, “user”, “client”).

2. Definitions

  • “Services” refers to construction services, real estate offerings, consultations, project communications, updates, and messaging.
  • “User” means any individual or entity accessing our services.
  • “Messaging Platforms” means WhatsApp Official API, RCS, SMS, email, or any approved communication channel.
  • “Applicable Law” refers to Indian laws, including the Information Technology Act, 2000.

3. Acceptance of Terms

By accessing our website or interacting with Swastik Builder via WhatsApp or RCS, you confirm that:

  • You have read and understood these Terms.
  • You agree to comply with them.
  • You are legally capable of entering into a binding contract under Indian law.

If you do not agree, you must discontinue using our services.

4. Description of Services

  • Real estate project information and consultation

Messaging is strictly opt-in and compliant with Meta and RCS policies.

5. Eligibility

6. Account Registration

9. Subscription Renewal & Termination

10. Use of WhatsApp Official API & RCS

Swastik Builder uses approved WhatsApp Business API and RCS channels for:

  • Service updates
  • Transactional alerts
  • Customer communication

Users must opt-in explicitly and can opt-out anytime.

11. Message Delivery & Compliance Policy

  • Message delivery is subject to telecom and platform limitations
  • Swastik Builder does not guarantee delivery timing
  • All messaging complies with Meta Business Policy and TRAI regulations

12. Intellectual Property Rights

All content, logos, designs, messages, and materials are the exclusive property of Swastik Builder.
Unauthorized use is strictly prohibited.

13. Confidentiality

We maintain strict confidentiality of user data and communications except where disclosure is required by law.

14. Disclaimer of Warranties

Services are provided on an “as-is” basis.
Swastik Builder disclaims all implied warranties to the extent permitted by law.

15. Limitation of Liability

Swastik Builder shall not be liable for:

  • Messaging delays or failures
  • Third-party platform issues

16. Indemnification

Courts in Raigad, Maharashtra shall have exclusive jurisdiction.
